‘Zagga’ fatally shot by cops in Old Harbour Bay

According to the police, the operation was conducted under the Firearms Act, with officers armed with a warrant targeting the recovery of prohibited weapons and ammunition in the Settlement Community. Upon arriving at a tenement yard with multiple dwellings, the officers announced their presence and called for occupants to exit one of the structures. The police reported hearing movement inside the dwelling and, upon opening the door, were met with gunfire from a lone individual. The officers returned fire, striking the man, later identified as Fothergill.
One police officer informed Old Harbour News that Fothergill has several run-ins with the law and was charged on multiple occasions in relations to crimes committed in Old Harbour Bay. However, he was never brought before the courts for these alleged crimes, the officer stated, because no eyewitness was willing to come forward and give evidence.
A .380 pistol loaded with a magazine containing seven (7) rounds of ammunition was reportedly recovered from the scene. Fothergill was rushed to the Spanish Town Hospital, where he was pronounced dead by the attending physician. The police have classified the incident as a shootout and have initiated an investigation into the recovery of the firearm and the circumstances surrounding the shooting.
Residents of the community have strongly contested the police's version of events. They allege that Fothergill was killed in his sleep and that no shootout occurred. Additionally, residents claim that CCTV cameras installed on the premises were removed by the police to conceal their actions. These allegations have raised concerns about the transparency and accountability of the operation.
The Independent Commission of Investigations (INDECOM) has launched a probe into the incident to determine the validity of the claims made by both the police and the residents, and also underscores the need for an impartial examination of the circumstances surrounding Fothergill's death.
The community of Old Harbour has been under a continuous 12-hour curfew starting 6:00 pm to 6:00 am daily.
